The National Industrial Court sit at Abuja, Nigeria capital had order the Academic Staff Union of Universities (ASUU) that they should have an end for seven monthss old strike.
He will deliver his ruling on the interlocutory injunction on the Federal government file on Wednesday, Justice Polycarp Hamman restrain ASUU from continuing with the industrial action pending the determination of the suit.
Justice Polycarp gives vacation judge order that this case should be moved to the president of the Industrial Court for reassignment to another judge.
He said that the ruling is for the benefit of the students. “No amount of compensation that can cover the loses of the students”. The matter of national interest and some student had already deprived from serving there father land for NYSC and also apply for other opportunities that restricted by age.
The lecturers had being on strike for the past seven (7) months now sake of government failure to honor their demands on salary payment platform among others – several talks between them and the federal government.
The students protest for ASUU strick would come and end.
Igwe asked the court to give the suit accelerated hearing sake of the urgent matter to enable students return school.
The counsel of ASUU and Senior Advocate of Nigeria, Oga Femi Falana, said that the union currently meet with stakeholders to ensure that the matter have being resolved to the court of appeal for government to cooperate with the union to resolve the matter.
James Igwe (SAN) lead the Counsel to Federal Government to hail the Judiciary as them ”save” educational development for the country .
”The recognise the fact that without education, rule of law won’t exit. I thank the judiciary for saving educational development. For the past seven months, educational development pause particularly for public universities in Nigeria, and it supposed not to be so.”
”Because when the fundamental pillar that development rest on pause for seven months, which means that entire economic, the entire social development also stop to be functioning, which supposed not to be so.
‘What will be the court agree with us, which they suppose grant interlocutory injunction against the academic staff union of universities to stop them to end the strike, pending the hearing and determination of the substantive suit, that will accordance with the rule of law.
”We are so much happy because we agreed on something to ensure that the bedrock of development in Nigeria, education wouldn’t not collapse.”
‘We are all going to check the best options for us’- ASUU
Counsel to ASUU Edoje Edoh said that they will study the ruling and look into the available options to know what to do next.
“The court rule will make ASUU stop the strike and return back the classrooms pending the outcome of the substantive suit. Plenty options has open for the union, we are all study the ruling with the legal team and we are going to adopt the most appropriate option.”
National Association of Nigerian Students(NANS) President Umar Umar Barambu was much happier with the court ruling begging government to keep to the agreement with the Union to avoid all this strike problem. Since ASUU down tools on February 14, 2022, and student being at home for the past seven months now. The vacation judge go handover the case for reassigning.
