The Academic Staff Union of Universities (ASUU) has said it will sue Federal Government to court for over the registration of the Congress of Nigeria academic universities “union” (CONUA) and National association Medical and Dental Academic (NAMDA).
The president of the Union, Prof. Emmanuel Osodeke confam has said that the National Industrial Court (NIC) they has sue the Federal government to court, to know why they register two factional unions.
“Yes this allegation was true, so we are going to go court” has said.
The Federal Government through the Minister of Labour and Employment, Chris Ngige register two factional academic unions on Tuesday that cause an issue about how government was handled the strike matter.
What is the reason why Government register new academic Unions
The two new factional acadmic unions that Federal government register was the Congress of Nigerian Universities Academics (CONUA) and the National Association of Medical and Dental Academics (NAMDA).
Minister of Labour and Employment, Chris Ngige, register the unions on Tuesday has said that the unions will exist with ASUU.
He also said that they will enjoy the rights and privileges that others academic unions for tertiary institutions had.
Meanwhile Counsel to ASUU Femi Falani (SAN) has said that the registration of CONUA and NAMDA was illegal.
He said that only one union suppose to exist for evry sector according to the Trade Unions Account.
“We can’t have two trade unions inside the same sector. Because it was only one union that is allowed to register for all academics for Nigeria.
“That was the reason for the grouping of trade unions sake, that we have mushrooms for the First Republic so that government will restructure the unions of all academics together and all non-academics together. You can’t have two or three inside one field,” he said.
According to Femi Falana one Supreme Court judgment on the proliferation of trade unions between Erasmus Osawe versus the Registrar of Trade Unions.
The Supreme Court rule “ said their freedom of association is not the total; and they will regulate it by Trade Unions Account so that unions will not be excess to everywhere.”
ASUU and Government Appeal Court for the Case?
Meanwhile the Court of Appeal WIl gives his judgement on Friday October 7, for the application for Academic Staff Union of Universities, ASUU fought against the Industrial court. On September 21, the National Industrial Court grant the interlocutory order of federal government, which they order university lecturers to resume work, pending the resolution of their dispute with the government.
Presiding Judge, Justice Barka Hamma, after arguements from the two parties advice that they has settle out of court yesterday.
ASUU was on strike for Eight months now and the strike start on February 14, 2022.
The Academic Union they are asking for their allowances that government was owe them, poor welfare, and payment software, plus others things.
